14. DIGITAL COMMUNICATIONS

By providing your mobile phone number, you consent to receive text messages from us, which may include promotional offers, service alerts, and company updates. Message frequency will vary based on your relationship to our practice and the nature of your membership, though you can generally expect to receive no more than 10 messages per month. Message and data rates may apply depending on your mobile carrier and plan. Your mobile number will never be sold, shared, or disclosed to third parties for their own marketing purposes. Patient Portal Access and Use

Align Wellness provides eligible patients with access to a secure online patient portal (the “Portal”) operated by Prospyr, a third-party healthcare technology provider. The Portal allows you to view portions of your electronic health record, communicate with our clinical team, schedule appointments, and access certain practice services.

Third-Party Service Provider

The Portal is provided and maintained by Prospyr. Your use of the Portal is subject to both these Terms and Conditions and Prospyr’s Terms of Service and Privacy Policy. By accessing the Portal, you agree to comply with Prospyr’s terms in addition to Align Wellness policies. Align Wellness is not responsible for the operation, maintenance, or security of Prospyr’s platform, though we select vendors who maintain HIPAA-compliant systems.

Eligibility for Portal Access

All patients age 18 and older who have established care at Align Wellness are eligible for Portal access. Access is provided upon completion of your initial consultation and remains active unless you request deactivation or your access is terminated due to violation of these terms.

The Portal is not available to persons under 18 years of age. If you are under 18, please contact our office at (401) 921-5934 to discuss alternative methods for accessing your health information.

Portal Access is for Individual Use Only

The Portal is intended for use only by the individual patient to whom access has been granted. You may use the Portal solely in connection with your own healthcare needs and treatment. Requesting clinical advice or information on behalf of another person is strictly prohibited and may result in immediate termination of your Portal access. Align Wellness assumes no liability for health information or advice accessed or used by persons other than the authorized user.

Password Security and Account Responsibility

You are solely responsible for maintaining the confidentiality of your Portal username and password. You must not share your login credentials with any other person. If you share your password or fail to adequately protect it, you will be responsible for all activities that occur under your account and any losses or damages that result.

All inquiries, messages, and actions taken through the Portal will be logged under your username. If you believe your password has been compromised, you must immediately reset it through the Portal or contact our office for assistance.

Portal is Not for Medical Emergencies

DO NOT USE THE PORTAL FOR MEDICAL EMERGENCIES. The Portal is not monitored 24/7 and messages may not receive immediate review. For any urgent medical situation, call 911 or proceed to the nearest emergency department. Do not attempt to communicate emergencies or urgent care needs through Portal messaging.

Secure Messaging

The Portal provides a secure messaging feature that allows you to communicate with our clinical team about non-urgent health matters. Messages sent through the Portal are not guaranteed to be received or responded to in real-time. Align Wellness will make reasonable efforts to respond to messages during normal business hours, but response times may vary.

You acknowledge that important health information may be communicated through Portal messages and you are responsible for monitoring your Portal account regularly. You agree not to hold Align Wellness or Prospyr liable for any losses, injuries, or claims resulting from your failure to read messages sent to you in a timely manner.

You agree that you will not use secure messaging to misrepresent your identity, harass or abuse staff, or transmit unlawful, abusive, defamatory, obscene, or offensive content.

Access to Health Information

The Portal provides access to portions of your electronic health record. You may not be able to view all of your health records through the Portal. Certain sensitive information, including records related to mental health treatment, substance abuse treatment, HIV status, or genetic testing, may be restricted from Portal access as required by state and federal law. To obtain complete copies of your medical records, you may submit a written records request to our office.

Data Security

Align Wellness and Prospyr employ industry-standard security measures consistent with HIPAA Security Rule requirements to protect the confidentiality of your health information. However, you acknowledge that no electronic transmission or storage method is completely secure.

If you choose to download, print, or save copies of your health information from the Portal, you assume full responsibility for maintaining the privacy and security of that information. Neither Align Wellness nor Prospyr is liable for any breach of confidentiality that occurs after you have removed information from the secure Portal environment.

Modification or Termination of Portal Services

Align Wellness and Prospyr reserve the right to modify, suspend, or discontinue the Portal or any of its features at any time, temporarily or permanently, with or without notice. Neither Align Wellness nor Prospyr is liable to you for any modification, suspension, or discontinuation of Portal services.

Termination of Portal Access

Align Wellness reserves the right to terminate or suspend your Portal access immediately, without prior notice, if you violate these Terms and Conditions. Upon termination, you are no longer authorized to access the Portal. Termination does not affect your ability to receive healthcare services at Align Wellness through other means.
